Refer
a Case to Dan Chamberlain
Many times
referring attorneys desire to remain involved in the case
through trial. We encourage such relationships and recognize
the importance of a “team approach” in the litigation
setting. Most states, including Indiana, require a written
agreement between the client and the law firm setting forth,
in part, the fees to be charged, litigation or other expenses
to be deducted from the recovery, and the manner in which
the fees are calculated. As of January 1, 2005, the Indiana
Rules of Professional Conduct (1.5(e)) require, in part, the
following:
1. that
lawyers may share fees in a personal injury case if:
a. the division is in proportion to the services performed
by each lawyer; or,
b. each lawyer assumes joint responsibility for the representation;
2. the client agrees to the arrangement, including the share
each lawyer will receive and the agreement is confirmed
in writing.
