Injuries caused by the failure to provide adequate security may be compensable.In April, 1998, the United States Occupational Safety and Health Administration (OSHA) made the following recommendations to protect the health and safety of employees and customers:
1. Increase staffing during high-risk periods.
2. Reduce store hours.
3. Install adequate lighting, drop safes and silent alarms.
4. Create bullet-resistant enclosures to protect store clerks.
The trend is to hold premises owners and occupiers liable for reasonably foreseeable injuries that occur on their property. A recent Appellate Court decision held that a man beaten in the parking lot of a 7-Eleven Convenience Store could hold the owners responsible when the owners were aware that juveniles often loitered in the parking lot and would engage in fistfights. Southland Corp. v. Superior Court, 250 Cal. Rptr. 57 (Cal. Ct. App. 1998).
